Public Order National Standards

Captain Spencer Fomby delves into the current industry standards that departments should consider when formulating policies, designing training, or managing protest events. Drawing from his esteemed position as the National Tactical Officers Association Public Order Section Chair and his hands-on experience in managing public order at his former agency, Berkeley PD, he will offer a plethora of insights. This session aims to equip you with comprehensive knowledge to effectively prepare for and manage public order scenarios.

Police and the Press: Balancing First Amendment Rights with Operational Challenges of Law Enforcement

Navigate the intricate balance between First Amendment rights and the operational challenges faced by law enforcement. This session, led by Attorney Mickey H. Osterreicher, General Counsel, will illuminate the rights and limitations of journalists and citizens in photographing and recording officers during their public duties. Key topics covered will include the First, Fourth, and Fourteenth Amendments, search and seizure, exigent circumstances, qualified immunity, interactions with First Amendment “auditors,” media-crowd management, and prohibitions against destroying or deleting files and recordings. The session will also encompass a thorough discussion on case law, buttressed by the most recent cases, rulings, and national trends. Participants will have the unique opportunity to engage with challenging questions, supplemented by photos and videos.
