This will be much more than a simple โhow-toโ background investigation course; this course will answer the question as to โwhyโ you conduct legally sufficient background investigations, and what happens if you donโt. We will discuss some of the โhow-toโsโ, but we will explore these topics in the context of the legal ramifications of background investigation failures. Together we will examine the current best practices in background investigations in order to mitigate, to the extent possible, some of the risks associated with hiring. We will explore legally sufficient background investigations in the context of failure to investigate, failure to vet and failure to thoroughly and completely screen our candidates within the parameters of the law.
During this course we will consider:
- Legal liability issues associated with background investigation failures for entry-level and lateral hires;
- Organizational impacts of background investigation failures and โred flagsโ to find during your investigations;
- The importance of cybervetting;
- Impacted Federal Statutes and related court decisions;
- Applicable accreditation standards and compliance requirements;
- Practical strategies for background investigations;
- andย Reporting and record-keeping requirements.

Joseph Race, an Associate Attorney at Daigle Law Group, specializes in policy and accreditation. A retired Madison (CT) Police Captain, he led the department to dual CALEA and Connecticut Tier III Accreditation. He serves as a CALEA Assessment Team Leader and is a Quinnipiac Law graduate, admitted to the Connecticut state bar and U.S. District Court. He also completed the Southern Police Instituteโs 76th Command Officers Course and the FBI National Academyโs 270th Session. A proud U.S. Marine Corps veteran, he remains active in accreditation efforts.
