Welcome to the Badges, Bots, and the Bill of Rights: AI and Social Media in Modern Policing. Artificial intelligence and social media are reshaping police work at every level — from the patrol officer drafting a report, to the detective running open-source intelligence, to the chief setting department policy. This session builds on last year’s discussion of constitutional limits in the digital sphere and turns the focus to what’s happening on the ground today. Participants will examine how AI tools are showing up in report writing, investigations, translation, evidence review, and social media monitoring, and what every officer needs to understand about the legal and practical consequences. Topics include discovery and disclosure obligations when AI touches a report, Fourth Amendment considerations for AI-assisted investigations, the evidentiary foundation needed when AI-generated content reaches a courtroom, civil rights and bias exposure, and the social media pitfalls that continue to generate lawsuits and disciplinary action. Through real cases, recent court decisions, and practical scenarios, participants will leave with a clearer understanding of how to use these tools effectively — and how to avoid the mistakes that put officers, agencies, and cases at risk.

This course will also focus on areas including: 

  • AI-assisted report writing, investigations, evidence review, and the legal responsibilities associated with documenting and disclosing technology use.
  • Social media investigations, First Amendment considerations, officer online activity, and the risks of bias, credibility issues, and disciplinary action.
  • Authentication, reliability, supervisory oversight, and courtroom defensibility of AI-generated, manipulated, or technology-assisted evidence.

Eric Atstupenas presently serves as the General Counsel for the Massachusetts Chiefs of Police Association. He serves as the secretary on the IACP Legal Officers Section board, a member of the IACP Committee on Human and Civil Rights, an associate member of the New England Association of Chiefs of Police and Central Massachusetts Chiefs of Police Association and serves on the Board of Directors for the Municipal Police Institute, Inc., a non-profit organization dedicated to providing training to law enforcement in Massachusetts.
